I've spent much of my career as both an attorney and a nurse, consistently working to advocate for people's well-being and quality of life. It's about ensuring that everyone has the chance to live authentically, feel safe, and know that they belong."

It is hard to believe that a law even similar to this exists in 2025, but it is unfortunately genuine. The "panic defense" allows a perpetrator to claim they acted violently due to the victim's gender or sexual orientation. Senator Collette's work on this bill echoes her unwavering commitment to eradicating such a dangerous and discriminatory practice from our legal system.

Why the LGBTQ+ Panic Defense Bill Matters

The LGBTQ+ panic defense may sound absurd, but it is a very real threat that is still active within the U.S legal system. "It is absolutely absurd," Senator Collette shared when discussing the law. "It stretches the brain to even think that this could be an acceptable defense for someone committing a crime."

Senator Collette and other lawmakers are working to confirm that LGBTQ+ victims of violence receive justice and that their attackers are held accountable, and not excused for their bigotry.

Senator Collette's consistent dedication to this cause is not simply about the elimination of one legal defense; it's about ensuring the safety of the LGBTQ+ community in Pennsylvania and protecting individuals from hate-based violence. The fact that the panic defense even exists echoes how much more work there is to do, and the fight needs to continue to create a world where queer and transgender people don't have to live in fear of violence.

During our conversation, Senator Collette also emphasized the importance of educating the public about these issues within the LGBTQ+ community. "The more people understand that these laws still exist, the more they'll realize just how out of step they are with our values," she explained.

It is very easy to assume that laws like the panic defense are simply relics of the past, and not necessarily something that impacts us. The reality is: they do. People are often unaware that these threats are real and can affect their lives.

According to the FBI, in 2023, there were 11,862 hate crimes committed in the United States which was noted to be a two percent increase from 2022. Of those crimes, 18.4% were motivated by the sexual orientation of the victim and 4.1% were motivated by the gender of the victim.
